Welcome to Out 'n' About Mobility
Your Statutory rights are not affected by any of the following terms and conditions.

1. Definitions

means Out 'N' About Mobility Ltd.
means the person or persons who have agreed to purchase from the Company
1.3. Goods: means 1.1 The Company : means Out 'N' About Mobility Ltd
1.2. The Customer: means the person or persons who have agreed
to purchase the goods from the Company 1.3. Goods: means the New or Reconditioned products that the Customer has agreed to purchase from the Company
1.4. Price: means the price set out overleaf inducing where applicable VAT and delivery
1.5. Conditions: means the conditions of sale set out in this document save where otherwise varied in writing and approved by the Company
1.6. The delivery date: means the date on which the goods are either defivered to the Customer or installed at the specied site or when the Company collects the goods from the Company
1.7. Finance: means any loan from a finance company to be used to purchase the goods
1.8. Deposit: means the amount set out as a deposit in this agreement
1.9. Installation: means the service of fitting the goods at the specified site
1.10. Installation address: means the address given by the Customer as the place that the goods are to be installed


2. ENTIRE AGREEMENT
2.1. These conditions of sale form the entire agreement between the Company and the Customer save where these conditions are varied in writing and approved by the Company
2.2. Signature of the Order shall constitute the Customer's acceptance of these conditions as the conditions applicable to the purchase of the goods by them >2.3. Where the goods are purchased by way of finance then the Customer agrees to be bound by these conditions of sale in consideration for the Company agreeing to sell the goods to the finance company

3. PRICE AND PAYMENT
3.1 The balance of the price after the deduction of the deposit (if any) shall be paid by the Customer to the Company upon delivery
3.2. Where the goods are purchased by way of finance delivery of the goods shall not take place until after the finance has been approved by the relevant finance company and the Customer agrees to sign any documentation required by the relevant finance company which is required for the Company to obtain payment from the finance company

4. RETENTION OF TITLE
4.1. The goods shall be at the Customer's risk from delivery/installation and from then the Customer shall be obliged to insure the goods to the value of the full price paid and against all risks
4.2. Ownership of the goods shall not pass to the Customer until such time as:-
4.2.1 the Customer has paid the price in full
4.2.2 the Customer has paid any other sums due to the Company
4.3. Until such time as the Customer owns the goods the Customer shall upon the request of the Company return the Goods to them at the location notified to the Customer by the Company

5. THE GOODS
5.1. The quantity and description of the Goods is set out here.
5.2. The Company reserves the right without notice to vary or alter any of the designs, specifications and packaging of the goods from those described in the Company's sates literature or that previously demonstrated to the Customer (where applicable)
5.3. In the case of Reconditioned goods the Customer accepts that the goods are Reconditioned and wifl not be of the quality or visual appearance as new Goods of the same type and the Goods are sold on an as seen basis

6. DELIVERY
The Company shall use all reasonable endeavours to supply the Goods promptly and in accordance with any agreed delivery date

7. WARRANTY
7.1 The Company will repair or replace, free of charge, any part or parts of any New Goods which the Company finds to be defective due to faulty material or workmanship within twelve (12) months of delivery, unless otherwise specfied
7.2 The Company will repair or replace, free of charge, any part or parts of any Reconditioned Goods which the Company finds to be defective to materials or workmanship within six (6) months of delivery or installation
7.3 The Company shall not be under any liability under clauses 7.1 or 7.2 of this clause if the Goods have in the opinion of the Company been altered, tampered with or used otherwise than in accordance with the instructions issued by the Company or where the name plate or other markings affixed to the Goods has been removed or defaced
7.4 The warranty given under dauses 7.1 and 7.2 is personal to the Customer and is not transferable in any circumstance.
8 RETURN OF GOODS/CANCELLATION RIGHTS
8.1 The Company will alow the customer to cancel this agreement within 5 working days of the date that this agreement was signed by the customer. In the case of Goods purchased by way of finance this will be in addition to their statory rights.
8.2 The Company shall not be under any obligafon whatsoever to accept the cancellation of this agreement once it has been placed, save in accordance with the provisions of dause 8.1 of this agreement
8.3 Once the Goods have been ordered the Company shall not be under any obligation to repurchase the Goods in any drcumstances

9. INSTALLATION
9.1 The Customer will allow the Company access to the installation address on the day of installation between 8.30am and 5.30pm or any other times as may be agreed separately between the Company and the Customer

9.2 The Customer will ensure that:-
9.2.1 the installation address is clean to enable the installation to take place
9.2.2. there is sufficient space to enable the instalation engineer to set out the Goods and install them
9.2.3. any necessary Building Regulation approvals have been obtained in advance and shall produce a copy upon request to the Company
9.2.4. the installation engineers can connect to mains electricity and other services in order to install the Goods
9.3 The Customer accepted that the Price is agreed on the basis that the installation will be completed within one visit to the installation address and accepts that if more than one visit is necessary due to no fault of the Company then additional charges will be incurred
9.4 Once the Goods have been installed the Customer shall inspect the installation and sign an approval certificate for the installation of the Goods

10 COMMISSION AND TESTING
10.1 The Goods will upon delivery or installation be demonstrated to the Customer or other persons specified by the Customer and a Delivery Note will be issued by the Company

10.2 The Company will not accept any liability for injury or damage where the Goods are used contrary to the instructions for use and demonstration

11 VAT
11.1 Where the supply of the Goods is exempt from VAT under Statute then the Customer will be required to sign a VAT exemption certificate to that effect

12 JURISDICTION
12.1 All disputes arising from this contract shall be subject to the exclusive jurisdiction of the courts of England and Wales
